Terms of Service and Deliverables Acceptance

This agreement establishes the legal relationship between TestimonialConsulting.com (the Provider) and the purchasing entity (the Client). Execution of this agreement confirms acceptance of the Testimonial System deliverables and the associated legal obligations.

I. Comprehensive Service Scope

The Provider delivers the Testimonial System to facilitate the collection and refinement of donor narratives. This system includes the following materials:

  • Strategic Framework: The system utilizes the four core goals of Captivate, Connect, Lead, and Promise to drive donor action.
  • Interview Protocol: Guidelines establish the curious listener approach to draw out authentic stories.
  • Technical Standards: Best practices ensure high quality audio and video capture through managed recording levels and lighting.
  • Editing Protocol: The system focuses on building emotional momentum while maintaining absolute authenticity.

II. Fees and Payment Terms

The Client agrees to pay the specified investment for the Testimonial Implementation Package and any requested consulting services. All fees are due upon receipt of the invoice. Access to digital materials is granted only after payment is confirmed. All sales are final. The Provider maintains the right to suspend consulting services if the Client fails to meet payment obligations.

III. Intellectual Property and Usage Rights

The Provider retains all ownership of the underlying Testimonial System methodology. Upon full payment, the Provider grants the Client a non-exclusive, perpetual license to use and adapt the provided materials for internal organizational purposes. The Client shall refrain from reselling, redistributing, or licensing these materials to third parties. All proprietary rights in the Testimonial System remain with Andrew Fisher and TestimonialConsulting.com.

IV. Limitation of Liability and Indemnification

The Provider delivers strategic guidance based on historical performance. The Provider excludes any guarantee of specific fundraising results or donor conversion rates. The Provider shall remain free from liability for any indirect, incidental, or consequential damages arising from the implementation of the Testimonial System.

The Client agrees to indemnify and hold the Provider harmless from any claims, losses, or legal fees resulting from the Client's use of the materials or any third party claims related to the testimonials collected. The maximum liability of the Provider shall remain limited to the total amount paid by the Client for the specific service in question.

V. Professional Consulting and Training

Consulting services are available to ensure successful integration of the Testimonial System. These services include:

  • Staff Training: Facilitation of live interview sessions and training via electronic communication.
  • Technical Instruction: Digital sessions for testimonial editing training.
  • Platform Integration: Guidance on utilizing digital platforms to solicit and manage testimonials.

The Provider remains an independent contractor. This agreement creates no partnership, joint venture, or employment relationship.

VI. Confidentiality

Both parties agree to protect any sensitive information disclosed during the engagement. The Provider shall maintain the confidentiality of Client donor data and internal strategy documents. The Client shall maintain the confidentiality of the specific proprietary methods contained within the Testimonial System.

VII. Governing Law and Dispute Resolution

Any disputes arising from this contract shall be resolved through mandatory binding arbitration. The parties agree to waive their right to a jury trial. The prevailing party in any legal action shall be entitled to recover reasonable attorney fees and court costs.

VIII. Acceptance and Execution

Engagement with TestimonialConsulting.com constitutes full acceptance of these terms. This document represents the entire agreement between the parties. Any modifications must be made in writing and signed by both the Provider and the Client.
